The city of Clayton, CA has an approximate population of 11,300. The Clayton Police Department is located at 6000 Heritage Trail. Clayton PD is comprised of 13 employees (Sworn and Civilian). The patrol officers are generally involved with DUI stops, investigations, and arrests.

DUI Enforcement by City of Clayton Police Department

The Clayton Police Department makes approximately 50 DUI arrest annually. The saturated areas for Clayton DUI stops and/or arrests are Clayton Road (the main artery in the town), and specifically between Kirker Pass Rd., and Oakhurst Dr. In this small 1.6 mile stretch of Clayton Road between Kirker and Oakhurst there are four restaurants/bars. Furthermore, Clayton Road is the main road, in the town, to reach Kirker Pass, which turns into Ygnacio Valley Road toward Walnut Creek and Highway 680 if traveling west, and goes toward Pittsburg and eventually runs into Highway 4 if traveling east. Officers will tend to extend their area of patrol outside the city boundaries further north down Clayton Rd. toward Concord and further west down Kirker Pass. Rd. The Clayton Police Department also has a history of pulling vehicles over that appear to be traveling along Clayton Rd. to Marsh Creek Rd., and do license checks. Much of the late night patrol occurs within a few blocks of the intersection of Ygnacio Valley Rd. and Kirker Pass Rd., despite the fact that most of the population of Clayton is remote to this location.

Clayton police officers generally administer a combination of National High Traffic Safety Administration (NHTSA) field sobriety tests (One Leg Stand, Walk and Turn, and Horizontal Gaze Nystagmus) and non-standardized tests (e.g. counting in reverse, alphabet test). A Preliminary Alcohol Screening (PAS test) is, as the name denotes, a preliminary screening device designed to allow officers to test for the presence of alcohol. However it is not uncommon for officers to try to get the numeric result into evidence. The PAS is designed to be a further field sobriety tests. The PAS is generally administered via a hand-held Alco-Sensor IV machine.

When Clayton PD officers believe an individual is under the influence of alcohol and/or drugs, they will arrest the individual and transfer them to Concord Police Department. Once at the facility the officer will generally offer the arrestee to take a breath or blood alcohol test.

The breath alcohol testing is done on a Dräger Alco-Test 7110 MKIIIC, as is the case for all agencies in Contra Costa County. If a blood alcohol testis chosen, the arrestee’s blood will be drawn at the Concord Police Department by a phlebotomist employed by Central Medical Laboratory (CML), a contract mobile laboratory collection agency. The blood sample will eventually be sent to the Contra Costa County Sheriff’s Crime Laboratory for analysis.

Joint Operations

The California Office of Traffic safety provided a $135,000.00 grant to be administered by the Office of the Sherriff, which will go towards funding the “Avoid the 25 DUI Task Force.” The task force will utilize the grant to concentrate on increased DUI enforcement and education throughout Contra Costa County. The life of the grant runs from October 1, 2013 until September 30, 2014. The task force is comprised of 25 participating agencies, as the name suggests, including the Clayton Police Department.

The Clayton Police Department generally engages in proactive enforcement of drunk in public violations resulting in criminal citations.
